These Terms of Service (“Terms”) form a legally binding agreement between you (“User,” “you,” or “your”) and The Poll App Ltd, governing your use of the App and all related services (collectively, the “Services”)
1. ACCEPTANCE OF TERMS
1.1. By registering for, accessing, or using the Services in any way — including but not limited to browsing the App, creating polls, or voting — you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
1.2. These Terms apply to all users, including registered and unregistered users, poll creators, voters, and viewers.
1.3. We may, at our sole discretion, modify or update these Terms from time to time. Updated versions will be posted within the App and on our website. Continued use of the Services after such updates constitutes acceptance of the revised Terms.
2. ELIGIBILITY
2.1. You must be at least thirteen (13) years old to use the Services.
2.2. If you are under 18 years old, you must have permission and supervision from a parent or guardian.
2.3. We reserve the right to verify your age and restrict or terminate any account found in violation of this requirement.
2.4. You are responsible for ensuring that your use of the App complies with all applicable laws and regulations in your jurisdiction.
3. REGISTRATION AND ACCOUNT SECURITY
3.1. Certain features of the App require registration and creation of a user account (“Account”).
3.2. You agree to provide accurate and complete information when creating your Account and to update it as necessary.
3.3. You must keep your login credentials secure and confidential. You are solely responsible for all activities that occur under your Account. 3.4. You must not impersonate any other person, use another user’s Account, or create multiple Accounts for deceptive purposes.
3.5. You must promptly notify us at info@zonaworx.co.uk if you suspect any unauthorized use of your Account or a security breach.
4. THE POLL APP SERVICES
4.1. The Services allow users to:
a. Create polls and questions visible to their followers or to the public via the Explore Page;
b. Vote on polls created by others;
c. View, comment, and interact with poll results and related content.
4.2. We may add, modify, or remove features from the App without prior notice.
4.3. We do not guarantee that all features will be available at all times or on all devices.
5. USER-GENERATED CONTENT
5.1. The App allows users to create, post, and share content including polls, comments, images, or other materials (“User Content”).
5.2. You retain ownership of your User Content but grant The Poll App Ltd a worldwide, non exclusive, royalty-free, perpetual, transferable, and sub licensable license to host, use, display, distribute, modify, and reproduce such content for the purpose of operating, promoting, and improving the Services.
5.3. You warrant that:
a. You own or have the right to share your content;
b. Your content does not infringe any third-party rights (including copyright, trademark, privacy, or publicity rights);
c. Your content complies with all applicable laws.
5.4. We may, at our discretion, remove or restrict access to any content that violates these Terms, without notice or liability.
6. ACCEPTABLE USE AND COMMUNITY RULES
6.1. You agree not to use the Services for any purpose prohibited by these Terms or by law.
6.2. You must not: a. Post or share content that is unlawful, defamatory, obscene, hateful, harassing, threatening, or otherwise objectionable; b. Promote discrimination, violence, or illegal activity;
c. Manipulate votes or create fake polls or accounts;
d. Post misleading or fraudulent polls (including those that impersonate individuals or entities);
e. Attempt to gain unauthorized access to the App or other users’ data;
f. Upload viruses, malware, or harmful code;
g. Use bots, scripts, or automation to interact with polls;
h. Harvest data or scrape information from the App without consent.
6.3. We reserve the right to suspend or terminate any Account engaging in prohibited conduct.
7. CONTENT OWNERSHIP AND INTELLECTUAL PROPERTY
7.1. Except for User Content, all rights in and to the App and Services (including design, code, software, trademarks, logos, and other intellectual property) are owned or licensed by The Poll App Ltd.
7.2. You are granted a limited, revocable, non-transferable licence to use the Services for personal, non-commercial purposes.
7.3. You may not reproduce, modify, distribute, or create derivative works of any part of the App without prior written consent.
7.4. You must respect all copyright and trademark notices displayed on the App.
8. PRIVACY AND DATA PROTECTION
8.1. We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

c. We are required to do so by law or regulatory authorities.
10.2. You may delete your Account at any time from within the App settings.
10.3. Upon termination, your right to use the Services immediately ceases, and all licenses granted to you shall end.
11. DISCLAIMER OF WARRANTIES
11.1. The Services are provided “as is” and “as available.” We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.
11.2. We do not guarantee that:
a. The App will be secure, uninterrupted, or error-free;
b. Any defects or errors will be corrected;
c. Content or data will be preserved or available at all times.
11.3. Your use of the App is at your sole risk.
12. LIMITATION OF LIABILITY
12.1. To the fullest extent permitted by law, The Poll App Ltd, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill.
12.2. Our total liability for any claim arising out of these Terms or your use of the Services shall not exceed £100 GBP.
12.3. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.
13. INDEMNIFICATION You agree to defend, indemnify, and hold harmless The Poll App Ltd, its officers, employees, and partners from any claims, damages, losses, or expenses arising out of:
a. Your use of the Services;
b. Your violation of these Terms; or
c. Your infringement of any third-party rights.
14. MODIFICATIONS TO SERVICES
We reserve the right to modify, suspend, or discontinue any aspect of the App, including features or availability, at any time without notice or liability.
15. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16.1. Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Poll App Ltd.
16.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force.
16.3. Force Majeure: We shall not be liable for any failure to perform due to events beyond our reasonable control, including technical failures or natural disasters.
16.4. Assignment: You may not transfer or assign your rights under these Terms without our prior written consent. We may assign or transfer our rights at any time.
16.5. Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
